Elon Musk's social media company, X, has officially settled a multiyear legal battle with the World Federation of Advertisers (WFA), a global advertising trade group, as announced on Wednesday. This resolution brings to a close X's aggressive legal actions against advertisers who withdrew spending from the platform due to brand safety concerns.

X Ends Legal Fight with Advertisers Group

The lawsuit, initiated by X in 2024, accused the WFA of orchestrating what it termed a "systematic illegal boycott" of the platform. This action followed a notable decline in advertising revenue after Musk's $44 billion acquisition of the social network in 2022, with X specifically naming major companies such as Mars, CVS Health, Shell, and Lego as having reduced their advertising expenditure.

Advertisers, however, consistently rejected these allegations, maintaining that brands retain the autonomy to determine where their advertising budgets are allocated. A federal court had previously dismissed X's lawsuit in March, with the judge ruling that the platform had failed to adequately demonstrate any demonstrable harm under federal competition laws, a decision X subsequently appealed in April.

Brand Safety and GARM's Role

In a joint statement, both the WFA and X Corp. declared their intention to move past the litigation involving the Global Alliance for Responsible Media (GARM), an initiative established by the WFA. X had contended that advertisers' reduced spending was directly linked to guidelines developed by GARM, a coalition comprising brands and advertising agencies tasked with setting standards to prevent advertisements from appearing alongside harmful online content.

These concerns about brand safety intensified after Elon Musk implemented significant changes to the platform's content moderation policies, leading many companies to fear their advertisements would be inadvertently associated with objectionable material.

Resolution and Future Outlook

"WFA reiterates its commitment to freedom of speech, a principle first included in WFA’s founding constitution back in 1953, and a principle it shares with X," the joint statement read. Crucially, the WFA announced that it had discontinued GARM on August 9, 2024, and would not re-establish it or any similar initiative, signalling a shift away from such formal brand safety coalitions.

Both X and the WFA expressed alignment on the view that ongoing innovation in brand safety will ultimately benefit brands, platforms, and consumers alike. This settlement, though resolving the legal wrangling, comes after a period of heightened tension, including Musk's famously blunt remarks to advertisers who had paused their spending on the platform.
